Questions on density issue

Real density question

Sara,

Isn?’t the real density questions relative to that of those that continue in office?

Now that THEY have given away this community?’s future with approving every housing project in sight (the densest concept of selling out) THEY seem to think that WE are dense enough to believe that THEY are qualified to solve the very same problems THEY created.

I believe there are better individuals out there to find REAL solutions. These clowns HAVE sold us down the river and WILL do so again.

Do you want to bet that if you held a candle on the far side of some of these Councilman?’s heads you could blow out that same candles flame from the near side?

Lou Postage is asking his critics to forgive him. He wants to ''put everything on an even keel.'' Sounds like he has a few critics here on this web site. Have your phones been ringing? Last year we were ''Selfess Zealots.'' The year before that we were ''Communists and Nazis''. Didn't old Lou tell us all ''to wake up'' this time last year? Wasn't he the one to start the negative actions what ever that means? How is he going to channel Lisa Reade in a positive direction??????? Sound to me as if she has her head on straight and doing what she feels is important. Lou She talked to you and Bill Wright and Criag Maxey a year and a half ago. Wright and Maxey claimed then they would get back to her. Did they lie or just have asenior moment? Maxey and Wright were nice to her then but what happened? NOTHING!! It is time for some new minds or maybe just some minds sitting at the city council. David Shaver is the only one listening and trying to control our growth before it over comes the taxpayers. If you want to appoint that new councilman Lou and make a statement do the housing moritorium and pass it as an emergency. I am sure David would support you on that.

Lou was the guy that said that Bushman knew what they (council or maybe Lou) wanted and they trusted her to go after it. This was refering to the 682 lots she contract zoned south of the city. She also gave away $1 Million to the developers during her free rein over the council in October 2001.


Lou come real close so you can hear me with out me shouting. GO TO H-E-L-L! Sorry I slipped. Lou how about us starting all over again? You be nice to me and I will not question what in the heck you are doing with our tax payers money. Nay I slipped again. Anyway you get the message.

Sorry to be so long in replying.

I do think that the statute should be read to apply prospectively and since the preference is for the courts to adopt the interpretation that upholds a statute , I believe this would be the case if we were sued on this issue.

I also believe there is nothing in the ordinance that prohibits a particular use as long as the overall use results in an average of two acres per unit fpr the development. Moreover, despite propoganda to the contrary, I see nothing about the statute that would make it applicable to nursing homes, independent living homes, hotels, motels or other commercial enterprises.

Last, I certainly agree with your statement that should a court determine a flaw in the statute, there is nothing to prevent council from simply amending the statute (or passing another) that would alleviate the problem while still preserving the intent of the voters to control growth through density restrictions.

The ultimate point is that if this mayor and council has the desire to control growth they will find a way to make this statute work. If they want to avoid restrictions on the ''rights'' of developers to build as many houses as fast and cheaply as they can, they will find a way around the statute. This has been the past behavior of council. I hope that things are changing. I learned long ago, however, to watch people's actions rather than listen to what they are saying.
