Fairness in Bella Vista?

Has anyone ever wondered why 1 house gets a notice for violations and the house next to it with a simular problem doesn't? I have wondered this myself and can only assume it is selective enforcement. I have a neighbor with an oil spot that they cleaned and did everything they could and still received notices yet another house close to theirs has horrible rust spots and if they have received a notice they have done nothing to correct it. Is it just me or has someone else had the same problem?

I can only agree with you on this from what is quite evident in the community. There seems to be a lot of things like this where you've only just begun to point one out. Basketball hoops stand out in my mind. I have to tell the stepdaughter that we cannot allow a hoop on a stand as we would have to put it up every night because of the bylaw rules.

One nagging questiong I keep having though is, what is the consequence of ignoring these violations? Can a homeowner be fined? I see nothing in the bylaws about fines for violations. So, what can be done to enforce the bylaws? Maybe we need some amendments. I think a 2/3 vote of the members can make new amendments to the bylaws.

I forgot to add that the stepdaughter asks why there are neighbors that have hoops so why can't we. I have to tell her that those neighbors are breaking the rules by not putting them away when not in use and that we don't want to be a rule breaker too. As anyone knows, buying and putting together one of those basketball hoops on a stand to sit on the driveway day after day, no one intends to drag them inside the garage to put away after each day's use.

I have been to one board meeting last year where the board members could not even agree on what 'when not in use' means. That they had to hire a lawyer to figure it out for them and guess what, they still don't know what it means and they spent your money for the lawyer's time. That was the last meeting I've went to because of that craziness.

Is it time for an overhaul of the board? Do board members get complacent after a time? I have not lived here long but I've been to a couple of meetings and got to meet the board members and I can honestly say, that things just aren't right.

I think it's time for some new government. Our assessments are way too high in my opinion also.

I received my coupon book for Bella Vista fees yesterday and sure enough they went up! The board doesn't get it! We have selective enforcement, lack of enforcement, issues that come up that could easily be taken care of but the board neglects them until they will be more costly to you and me. Meanwhile they themselves break the rules but expect us to abid by them. I am sick of it and think we should contact the state department that oversees boards and Hoa's. I looked over the budget and I have serious concerns about some of the expenses. The problem is most residents won't stand up for their own rights. I have ended a relationship with the board president because of the way things are going and feel hostile at this point! Hopefully I can control myself before I get into trouble. Who am I kidding? You and I are the only ones who see this post anyhow. They don't care as long as they can cram the bullshit down are throats.
