We felt the need to offer a rebuttal to Kevin Reilly's slanderous and inaccurate message about the HOA.
Let us first start by saying that we are as well concerned about the inoperable vehicle that Kevin mentions, however, no one has been able to provide us information as to who this vehicle belongs to. Therefore, it makes it difficult to warn, fine or take additional action against an owner that we aren't able to identify.
Secondly, Kevin's comment saying the HOA has not replied to his e-mail is 100% inaccurate. The HOA responded to Kevin's e-mail on 10/12/09 in a little over 5 hours after it was sent. Kevin, here is a link to our response which clearly shows that we did respond to your e-mail.
Thirdly, the subject of this post questions whether the HOA rules are being enforced. All the rules of the HOA are actively being enforced, the HOA has sent hundreds of warnings, fines, letters and other correspondence in an effort to enforce ALL of the HOA rules.
Now let's discuss the larger subject of the inoperable vehicle, which is of concern to all. The HOA is reliant on member feedback/input in enforcing HOA rules. In this case, Kevin's initial e-mail brought this to our attention. This inoperable vehicle is violating HOA rules as well as City of Delaware Ordinances. As you can see from our e-mail, we sought from Kevin whether he knew who the vehicle was owned by, we never received a response. Without any information as to who owned the vehicle, there is no way for the HOA to take enforcement action. We could warn/fine the house it is parked in front of but just because it is parked in front of a house doesn't mean that person owns it. Maybe we should send warnings to all residents on Weltergon, but there is no way to know if the owner even lives on Weltergon, they may live on another street in the neighborhood or the owner may not live here at all. We can't just randomly send warnings and fines without any factual evidence as to who the owner is. With that said, does anyone who is reading this post know who the owner of this vehicle is? As we mentioned in the e-mail to Kevin, this vehicle is also violating City of Delaware Ordinances, which we provided to him. The HOA encouraged him to contact the police to assist in this matter as well. As with all situations where City laws are being violated, homeowners are encouraged to call the police. In this situation, without being able to identify the vehicle owner, this is most likely the best course of action to remedy this issue.
There is a misconception among many that it is HOA's responsibility to call the police when City laws are being broken. The HOA is responsible for enforcing its rules and our responsibilities do not involve us being dispatchers of the police. If you are aware of a law being broken and are deeply concerned about it, you are encouraged to call the Police. We understand that his may get some dirt on your hands in the process, but that is what is required.
