HOA rules being inforced???

How long can a car on a jack parked in front of a fire hydrant remain??  I have counted 5 weeks so far.   It's nice to see the $15 a month we all pay being put to good use.   I thought one of the ideas behind an HOA was to help maintain a decent property value.

 

I realize none of us probably want an HOA but we were forced into one because of Maronda building a park and the retention ponds.   I also realize those memebers of the HOA are volunteers however they did "run" for those positions. 

 

I once received a late fee on a HOA payment that I made 3-5 days before the due date.  When I got my statement, I questioned how it takes so long for a check mailed from Delaware to get to Lewis Center.   I was then reminded of HOA members are full time employees and family....and if I didn't agree with the turn around time that I should volunteer my time to check the P.O Box for the HOA.     That's fine but I did not "run" for a position in the HOA so my only responsiblity is to pay my fee on time.

 

I am posting this message today because I emailed the HOA prior with no reply.  If you don't want the responsiblity of being a member or putting up with a-holes like me, then don't run for the position.

There have been some times in the past when I wonder if rules have been enforced as well.  One neighbor had a washing machine on their front porch for quite some time, not the image that we want to have for our neighborhood.  There is an empty house, now HUD-owned, in our neighborhood and someone has been parking his/her car in the driveway as if it is his/her personal parking spot now.  I do hope issues like these get addressed.  I've lived in neighborhoods where the HOA has been more active in maintaining certain standards.

Thanks for the reply!   I have been trying to sell my house for 13 months.  I just re-listed and hope to have better luck this time around.   I have lived here for over 7 yrs. and the appearance of our subdivision from time to time can be frustrating.

We felt the need to offer a rebuttal to Kevin Reilly's slanderous and inaccurate message about the HOA.

 

Let us first start by saying that we are as well concerned about the inoperable vehicle that Kevin mentions, however, no one has been able to provide us information as to who this vehicle belongs to.  Therefore, it makes it difficult to warn, fine or take additional action against an owner that we aren't able to identify.

 

Secondly, Kevin's comment saying the HOA has not replied to his e-mail is 100% inaccurate.  The HOA responded to Kevin's e-mail on 10/12/09 in a little over 5 hours after it was sent.  Kevin, here is a link to our response which clearly shows that we did respond to your e-mail. 

 

Thirdly, the subject of this post questions whether the HOA rules are being enforced.  All the rules of the HOA are actively being enforced, the HOA has sent hundreds of warnings, fines, letters and other correspondence in an effort to enforce ALL of the HOA rules.

 

Now let's discuss the larger subject of the inoperable vehicle, which is of concern to all.  The HOA is reliant on member feedback/input in enforcing HOA rules.  In this case, Kevin's initial e-mail brought this to our attention.  This inoperable vehicle is violating HOA rules as well as City of Delaware Ordinances.  As you can see from our e-mail, we sought from Kevin whether he knew who the vehicle was owned by, we never received a response.  Without any information as to who owned the vehicle, there is no way for the HOA to take enforcement action.  We could warn/fine the house it is parked in front of but just because it is parked in front of a house doesn't mean that person owns it.  Maybe we should send warnings to all residents on Weltergon, but there is no way to know if the owner even lives on Weltergon, they may live on another street in the neighborhood or the owner may not live here at all.  We can't just randomly send warnings and fines without any factual evidence as to who the owner is.  With that said, does anyone who is reading this post know who the owner of this vehicle is?  If so, please e-mail the HOA at kesslebrookeHOA@aol.com

 

As we mentioned in the e-mail to Kevin, this vehicle is also violating City of Delaware Ordinances, which we provided to him.  The HOA encouraged him to contact the police to assist in this matter as well.  As with all situations where City laws are being violated, homeowners are encouraged to call the police.  In this situation, without being able to identify the vehicle owner, this is most likely the best course of action to remedy this issue.

 

There is a misconception among many that it is HOA's responsibility to call the police when City laws are being broken.  The HOA is responsible for enforcing its rules and our responsibilities do not involve us being dispatchers of the police.  If you are aware of a law being broken and are deeply concerned about it, you are encouraged to call the Police.  We understand that his may get some dirt on your hands in the process, but that is what is required.

 

As we said before, the HOA is actively involved in enforcing the HOA rules, but we are highly dependent on feedback of homeowners making us aware of potential violations.  All homeowner's are encouraged to send any questions, comments or concerns to kesslebrookeHOA@aol.com
