I hear you, and I would be devastated if I hit a child, however, an unattended child is the responsibility of the parent unless the driver is negligent(speeding), I do agree completely, that being pro-active is the best option, whether it's speed humps, lowered speed limit or not allowing children in the street etc... My youngest was 12 when I moved into RT, but no in our old neighborhood they weren't allowed to play in the front yard unless we were out front with them, and teaching kids to stay away from the street is no different than teaching them not to play with the stove, or an electrical outlet, and surely it's not the fault of the guy that wired your house, or the stove manufacturer if your child gets burned or electrocuted, in fact to many of these occurrences and CPS would surely take the child out of the unsafe environment or make the parent take PEC's(parenting education classes) Sometimes there are so many unattended kids in the streets you can't safely drive , so if a child is hit and the driver is not breaking the law, where does the responsibility lie? Unfortunately, like you said whose right whose wrong doesn't matter, the victim(child) is still the victim. I have a friend that was sued by a driver because she had one of the yellow tent signs that say "Child at Play" in the street, she was sitting on the drive in her lawn chair watching her kids(she does childcare) the driver rounded the corner was startled by the sign in the street, swerved to miss the sign, ran up in the across the street neighbors yard damaging her car, and injuring the driver(she sued, she won, and my friend now has a judgment against her because the obstruction was hers and was illegally placed, thank God, there was not a child in the other yard, extreme, I know, but whose fault would that have been? I know it's a tall order but people need to not only slow their roll, but keep there kids out of the street. Speed humps, lets get them, but ultimately it's the responsibility of the parent to keep their kids out of the street, just like it's their responsibility to make the go to school.
