HOA Is not in effect now and no one cares!!!

Specifically Lucas on page 4 of this thread in your post your first sentence reads "I'm against this HOA also" but by the time you finish it your asking for our vote to be president of our board in the last sentence!

There are a lot of questions.  We are going to further our discussions with NNI.  NNI is attempting direct contact with Chuck.  The neighborhood is collectively in agreement that a HOA is not wanted.  Within the many questions being asked to NNI, is  IF we have to take the HOA when it is turned over by Trusty to the neighborhood, can we amend all the restrictions  OR  if we do not do anything with it will it expire at some point.  No one is trying to form an HOA.  According to the hand out  Section 19 refers to the HOA.  Previously, a Neighborhood Association is a modern term for a respectfully, glorified neighborhood watch w/ block watch captains and crime watch signs posted was being attempted. However once again the efforts for this was stopped in March 2011.  Then Chuck Weber contacted me due to my association with the above mentioned Neighborhood Association ate.   Once again there has to be order and organization, which would require a spokesperson/leader/and it may have to be stated president, and supporters in a small group.  To have an all out disrespectful brawl will do the neighborhood no favors.   Lucas is only being proactive in trying to solve this situation to the best interest of the neighborhood and once again the majority does not want an HOA.  Progress is slow sometimes when dealing with something of this nature.  Let us all understand Hampton Meadows collectively does not want an HOA.  Please be proactive in your responses knowing there is work being done to try and resolve what is written in the handout.  Nancy

Nancy, thanks for chiming in here.  I still don't understand why you think that we might have to or will be forced to accept anything trusty has to hand over.  I have read section 19 of the handout and it says "The parties hereto may, entirely at its option, at any time, form or cause to be formed the Homes Association"...The way I understand it is DON'T START NO HOA WON'T BE NO HOA!  If no one accepts anything trusty offers to hand over then it will automatically be dissolved and right now the only person willing to do that is you and Lucas who both want to be president.  The only thing trusty has to hand over is a list of covenants and restrictions which can be used when forming an HOA.  I don't understand how you can be against an HOA but be talking about creating a board or having a president with officers?  Again the only people who seem to want to create an HOA  is you and Lucas and according to Lucas, his reasoning is you have to form the HOA so you can turn around and dismantle the HOA he claims presently exists.  I'm still trying to figure that one out since we do not have an HOA.  An HOA will not be forced upon us if we choose to do nothing but what scares me is someone who is willing to form a board while trying to use scare tactics to get it done. You make it seem like we are under some kind of eminent danger of being handed over to a dictator so you can get people to think that we have to create a board with officers and a president to prevent it which is the same thing as creating an HOA!  I still question your motives for creating an HOA.  I agree with you say that we do not want an HOA but its this board with a president and officers that I disagree with and I think you are trying to sneak one by.  If it walks like duck and quacks like a duck...its a duck!  And this sounds like an HOA to me!  Has Trusty enforced any of the rules in that handout so far after all these years? 

I have been in contact with NNI, which deals with neighborhood issues including HOA and Neighborhood Associations, it appears to them that Trusty does have the HOA.  We are trying to work through the process to not have an HOA.  If we have to have, in order to abolish the HOA from Trusty, a board etc to perform the duties to amend the restrictions etc. then that is when that will take place.  I have been to many group meetings, from school, church, business etc, there is always a spokesperson to conduct the meeting.  There are at times many supporters/workers to help organize and make the meeting successful.  We can not barge in un-organized and or expect anyone to work with us or for the neighborhood acting in a non-professional way.  If you know the legal terms and conditions about HOA's and what is being explained to us by the ones that does know please join us, more knowledge is a good thing.  We are hopeful that we will not have to take the HOA from Trusty and end it legally before it is handed over.   PROCESS is a big term with a lot of discussion and legalities.  We need to do it right to be successful.
