An employer
An employer can apply anything they wish when evaluating employees. As long as what is evaluated and then used against the employee for cause isn't an already protected right. Smoking is not. Motorcycle riding is not. An employer can analyze any at-risk actions undertaken by an employee that could have an affect on the business or its employees. Character included.
What you might be calling ''freedoms'', Dave; others might call abuses.

I think maybe
you're misunderstanding my point. What I choose to do at my home is my right and I have the freedom to do it as long as there is no law prohibiting it's action or use. When a employer crosses this line into my home or private life and makes judgements. Then place those judgements into action that effects my life. It may not be illegal, but it's morally wrong.

That's still wrong.
Character/morals is who we are. Your character does not change when in your house or in your work place.
But yet, many employers in many workplaces can fire someone for bad moral character.
Being fired for cause because of bad moral character is not new.

I think you're wrong
but thanks for keeping this peaceful. A employer can make a moral judgement on issue that are illegal. Lets say I get a DUI. My employer could and would fire me based on the morality of the issue. However, could they fire me based solely on the fact I drink? Drinking is not against the law and in some religions it's required so to fired based on this moral belief would be wrong. In right to work states (RTW) a person can be fired without cause. But that's not the case here because a cause is being given. IE Drinking.
I don't know...... Still checking.
The whole concept is just out there. Everytime I think about it a new question come up.
