Association Problems

Things have gotten hectic today so I don't know when I'm going to get the chance to contact the mayor. Can someone else set something up? I was wondering if we should have an association meeting with the mayor at the clubhouse?

I contacted city of bondurant and they told me

 

 

-The City is not involved in any Homeowner’s Association including the one at Wolf Creek.  I’d suggest contacting facility owner Mark Hammersma with your questions.

For everyone out there that isn't paying there dues, I strongly suggest that you do.  I have posted the copy of the covenants that I received and agreed to when I purchased my house.  Now I am not a lawyer, but by signing a document saying that I received the covenants, and the language listed on the covenants I am agreeing to it by purchasing a property located in this subdivision.  I have a friend that was the president of his homeowners association for a time.  They would take the people to court that were not paying the dues and get a judgement against them.  If that judgement wasn't settled, the sheriff would come in and take their property, have a 'tax' sale and sell the house.  The money from the sale would go to the banks first that held the mortgage, then the homeowners association to cover the unpaid balance, with the remainder going to court costs and finally to the homeowner who just lost thier house.  Now he could've just been blowing smoke up my (you know what) but by reading over the language in the covenants, I think that it could be possible.  In any case, please at least talk to a lawyer about it before it's too late.

Now as far as the homeowners association is concerned, I know for a fact that there is a board that meets.  I only know this because Mark had asked me to post a note at the clubhouse, after/during a snowstorm just after Christmas when we were all snowed in, stating that the homeowner's association meeting had been postponed.  He asked me to do this because I had just contacted him earlier in the week regarding a maintenance issue and still had my number in his call history.  I don't know who is on it, but I do know that Mark is the only voting member and he will be until he sells the last property or he gives up this right.  I suggest that we keep an open forum for now and when we have enough members to break even on costs, we should start meeting and try to persuade Mark to give up this right and let us take over the duties of running everything.
