*** Annual Meeting Postponed ***

Ok let me get this correct.  In December the HOA board attempted a Annual meeting ( that will satisfied the year 2009 ), but the Annual meeting could not be made because a quorum was not made.  So then in January instead of asking the lawyers if this attempt will satisfy the Annual meeting, you had the new Managment company try to print out ballots and send them to the home owners for another attempt at an Annual meeting in January 2009.  The Management company told you the ballots were printed and sent out ( don't remember the dates exactly) January 11th to the 14th.  Then somewhere around January 25th it was discovered that the ballots were never mailed out and the "Printer was broke" AGAIN.  So at that time you talked with the lawyers and they told you an attempt was made and that's good enough. 

When was the last Annual meeting held, not attempted buy held ?

Was Oasis paid for ballots and shipping that NEVER happened ?

 

Now on to the second paragraph.  I know you told me that Kachina did not provide Octobers financials, I find that very hard to believe that our lawyers can not demand all receipts and transaction history from Katchina.  Once again I sure hope we did not pay Katchina for the month of October.  You state that Oasis has created a report for October, and they should have November since they were employed by us at that time.  It is Feb. and you still do not have Decembers financials ?  It sounds like you have Oct and Novemebers  ..... POST them.  Correct me if I am wrong but I don't think it costs anything but your time to post pdf's on the main page.

I really am having a hard time getting a hold on all of this mess>  first we can't have a annual meeting cause it would cost to much to have another ballot sent out with a notice of the annul meeting. But you can send out a newsletter and a statement about the error in the dues. can you tell me what is wrong with this picture?

 Why couldn't you of sent the ballot and notice out with the newsletter it would seem to me that is a way to save money and since they were already printed up why could that not happen?

As for the financial reports am still waiting as I find them very interesting and have a lot of questions on some of the spending that has gone on. like the upgrade on the community it seems to me that we were spending money like a drunken sailor and no offence to our proud sailor. But my goodness almost $44,000 what in heaven sakes what this all about?

The last annual meeting was the beginning of 2008.  The annual is held to look back at the previous year and present the budget for the upcoming year, so this annual meeting, which we did not have, would have been for the year 08.  Oasis was not paid for the mailings that did not go out.  And to answer your question about the lawers, Oasis contacted them after the second mailing failed to go out.  We cannot keep the old ballots and add to them with a new round of mailings.  You need to start from scratch every time you attempt an annual meeting.  This, I am told, is state law.  So, with the turn out that we had, and I am appalled that we cannot get AT LEAST 130 freekin homeowners to return a ballot, we did not reach the quarum, thus, it was illegal to hold the annual, which is why it was cancelled.  So, in order to attempt another annual, we would have to start over and remail ballots, which is what the plan was...until the printer failed us.   Then Oasis contacted the lawers and they said it was obsurd for us to continue to waste money that we don't have to keep sending out ballots in an attempt for an annual.  They say that because we sent out ballots and failed to reach a quarum, it satisfies the requirement for an annual meeting.  If you have any further question about this, call Brett, maybe he can explain it better, I cannot.

The financials....once again, Kachina did not provide them....they did however provide receipts, that is how Oasis was able to produce a statement for us.  I just received the financial statements from October, November, and December.  They don't have Januarys yet because they are generally 15-30 days behind on the statements, which means I should have January's very shortly.  (Mary at Oasis is working diligently on this for me!).  You are right, it does not cost me anything to post the financials, just my time, but I am going to post them all at once.  I post them as a courteasy to the community members.  I am not required, nor is the board, to post these online.  I do it because I think it is obsurd that you need to pay for copies if you request them from the management company.  But, if you are that curious and cannot wait until I post them, feel free to contact Oasis, they are required to provide a copy to you upon request.  But they are going to charge you for copies and postage.  Patience....I will post them soon.

What's wrong with this picture is that the longer we wait to hold an annual meeting, the longer you all have to wait to hear about community issues.  We cannot legally hold another meeting until an annual is done.  So, if we attempt another annual, and fail, it is going to be at least a month past that date before we can hold a meeting and get info out to everyone.  If we go with our lawers advice and consider the annual meeting taken care of with the first round of ballots, that allows us to now go forward with regular meetings starting this month.  That means, if you show up to our meeting, you will get information on the community, you will not be turned away...again....because we did not reach a quarum.

I will fully explain the financial situation at our meeting this month.  Please attend the meeting, I have no plans of typing the info on this blog.
